IAM RoadSmart Terms and Conditions

1. General terms

1.1. IAM RoadSmart is a road safety charity (Registration England & Wales 562530, Registered Charity Number 249002 in England & Wales, SC041201 in Scotland) with Head Office located at: 1 Albany Place Hyde Way Welwyn Garden City Hertfordshire AL7 3BT.

1.2. IAM RoadSmart may also mean IAM, IAMRS, Institute of Advanced Motorists, or any other trading name the organisation may use from time to time.

1.3. The copyright and all other intellectual property rights in our materials and the content of them are owned solely by us and you may not copy or reproduce any part of them unless we give you a written agreement to do that.

1.4. The prices of products and services will be as quoted on our website or over the phone at the time you make a purchase. We take all reasonable care to make sure that the prices are correct at the time when they are entered onto the system.

1.5. We are committed to protecting your privacy. We comply with the principles of the UK General Data Protection Regulation (UK GDPR) and aim to maintain consistently high levels of best practice in our processing of personal data. You can read our privacy notice here Privacy notice

1.6. By booking an on-road course/assessment with IAM RoadSmart, you confirm the following:

a) You hold a valid, full UK driving licence, not a provisional licence, for the relevant vehicle.

b) You have access to a roadworthy vehicle with:

  • Full and valid insurance to drive or ride the vehicle
  • An MOT Certificate (if applicable).
  • Appropriate vehicle tax (if applicable).
  • Your vehicle can achieve and maintain the national speed limit when it is safe and legal to do so.
c) Your eyesight meets the minimum legal requirements (with glasses or contact lenses if worn).
d) A legal helmet with suitable eye protection and motorcycle clothing, gloves and footwear that offer impact protection will be worn when riding (Rider only).

e) You have not had your licence revoked or suspended, been advised to stop driving by your GP or other medical professional or have been formally referred to Driving Mobility.

1.7. You will be asked to sign a declaration when attending your course/assessment/test session to confirm the above.

1.8. IAM RoadSmart reserve the right to cut short or terminate your course/assessment/test and refuse to refund any payments made for this product/service if:

a) you fail to meet any of the conditions listed in para 1.6,
b) we strongly suspect that you are under the influence of drugs, prescription medication that affects driving ability, alcohol, and/or
c) your standard of driving is unsafe or illegal.
d) You use a dashcam or other camera to film or record audio from any of the sessions without the prior agreement of the observer or examiner. Where this is agreed, footage must not be posted without written authority from IAM Roadsmart Chief Examiner.

1.9. Our courses are all delivered either by trainers who are DVSA registered or by suitably qualified volunteer Observers who are experienced in delivering advanced driver or rider training. You may have more than one observer allocated during training, but they will all be operating to the same national standard. Our examiners are likewise qualified to our National Standard. If your course includes a final test, it will always be delivered by someone who has not delivered any of your course sessions to guarantee an objective evaluation.

1.10. In addition to the assigned volunteer, there may be a staff member present during the course/assessment/test for quality control purposes.

1.11. You must pay the full price of the course/assessment at the point of purchase. The course/assessment session will not start before you make the purchase.

1.12. If a product/service you purchased includes a test, you can only take this test once. IAM RoadSmart is not liable for any failed tests. If you fail and wish to take the test again, you must buy a relevant re-test.

1.13. You cannot request a specific examiner for your test, but if you need to take the test again, you can ask that the examiner is different to the one who did your previous test, and we will endeavour to provide this if possible.

2. Special requirements

2.1. We are an inclusive organisation and where possible we will make reasonable adjustments to ensure that our courses are accessible to all. If you have any specific requirements in this area, please contact us in advance so that we can accommodate this where possible. We cannot be held responsible if we have not been notified in advance and at the very least this will cause a delay in our service delivery.

3. Changes, cancellations, and refunds

3.1. Refunds for product/service purchases and gift voucher purchases will be subject to an administration fee of £35 and will only be considered if:

a) a refund request is submitted within 14 days from the date of purchase (i.e. within the cooling off period), and the course session/assessment/test has not started yet.
b) you cannot take the course or assessment due to illness, accident, or mental health challenges. In such cases, requests for a refund must be supported by appropriate documentation, such as a medical certificate and you must inform us that you wish to cancel a product/service at least 20 days before commencement.

3.2. We will not offer any partial refunds.

3.3. Membership fee refunds will only be considered if:

a) incorrect Direct Debit payment is taken in error by IAM RoadSmart, or
b) we receive a membership cancellation request from a Direct Debit payer at least 1 day before the new membership is due to start and we have been unable to stop the Direct Debit payment collection, or
c) we are notified of a Direct Debit payer’s passing away and we are unable to stop the collection of payment via Direct Debit, or
d) we are notified of a member’s passing away within 6 months after the payment(s) has/have been collected by Direct Debit or standing order, or
e) membership by exemption applicant fails to provide documents that prove their advanced driving or riding qualifications within 2 weeks from the date of purchase.

3.4. If a refund of membership fees is made by IAM RoadSmart it will only amount to the value of the most recently paid membership fee; earlier payments will not be refunded under any circumstances.

3.5. We cannot refund any portion of the membership fee if you cancel your membership in the middle of your membership year.

3.6. We cannot give any refunds for lost or stolen gift vouchers, lost gift voucher codes, or for expired vouchers.

3.8. Nearly all our courses and assessments are delivered by volunteers, therefore at the time of purchase we cannot guarantee that there will be a suitably located and appropriately qualified volunteer available. In the unlikely event that we cannot deliver your course due to volunteer unavailability or other unforeseen circumstances on our part, we will endeavour to provide a solution acceptable to you and to IAM RoadSmart.

If we have been unable to provide a solution, you will have the option of cancelling and receiving a full refund if you ask for it within 6 months of being notified for the first time that the course cannot be delivered. IAM RoadSmart cannot be held liable for any other financial costs that you may incur because of cancellation.

3.9. If there is a test included in the price of the product/service that you have purchased, you will not receive a full or a partial refund even if you choose not to take the test at the end. We will also not give any refunds for any failed tests.

3.10. If your assigned assessor, observer, or examiner evaluates your performance, establishes that no further progress can be made and terminates your training following approval from IAM RoadSmart or the local Area Service Delivery Manager, we will not be able to offer either full or partial refund for the course/assessment.

3.11. IAM RoadSmart cannot transfer your purchased products/services to another individual.

3.12. If for any reason you are not able to start the course, and your cooling off period has passed, you may request to put your course on hold for a specific time period, but no longer than 6 months from the date of your request.

3.13. If a refund has been authorised, it should be processed within 2 weeks from the point of authorisation.

4. Advanced Driving / Riding Courses and Masters Courses

4.1. The price of Advanced courses includes 12 months of IAM RoadSmart Associate membership, a group contribution, 6 - 12 course sessions, all relevant course materials, and advanced test at the end. More sessions can be requested by it will be at the discretion of the group to determine if they can support such requests.

4.2. On top of the advanced course price, your local group may request an additional contribution to the running costs of your Observer’s motorcycle (applicable only to riders).

4.3. If you already are a current member and purchase an Advanced course for another type of vehicle, the price you pay will not include a 12-month membership (at the associate rate) as you are already paying for your full membership.

4.4. We expect our customers to complete their advanced course within a 12-month period. If your course exceeds 12 months, in order to continue you will be required to renew your associate membership for another year by paying the associate membership fee. If the associate membership fee is not paid within 3 months of the membership expiry date, their membership will lapse, and the course will be cancelled.

4.5. Associate members must continue to pay their annual membership fee even when their course is put on hold.

4.6. In order to purchase a Masters course you must be a current Full or Fellow member with fully paid-up membership fee for the current year.

4.7. The price of Masters course includes up to 6 course sessions, all relevant course materials, and a test at the end.

4.8. If your assigned observer/mentor, having evaluated your performance, states that no further progress can be made, IAM RoadSmart or your local group in consultation with the Area Service Delivery Manager may cease your Advanced or Masters training providing you with feedback on why they came to this decision. As per paragraph 3.11 we will not be able to offer either full or partial refund for the course/assessment.

5. Skills Days

5.1. Skills Days are special events organised by IAM RoadSmart and have their own set of terms and conditions which will have to be accepted by each ticket buyer before they complete their purchase. Please refer to the Skills Days page on our website to see these terms and conditions.

6. Gift Vouchers

6.1. Gift Vouchers must be paid for in full prior to redemption. The voucher purchased can only be redeemed against the corresponding product and cannot be transferred to an alternative product or used as a full or partial payment for an alternative product.

6.2. To redeem the voucher, the voucher code must be quoted.

6.3. The voucher is valid for one year from date of purchase, after which point it cannot be redeemed or refunded.

7. Membership

7.1. Each member of IAM RoadSmart must agree to be bound by the IAM RoadSmart Articles of Association and Code of Conduct in paragraph 8.

7.2. There are three membership tiers:

a) Associate
b) Full
c) Fellow


7.3. In order to become an Associate member of IAM RoadSmart you must purchase an IAM RoadSmart Advanced course. The course price includes 12 months of associate membership.

7.4. In order to become a Full member of IAM RoadSmart you must:

a) Pass the advanced driving or riding test, or
b) Apply for membership by exemption and send us a proof of relevant driving or riding qualifications within 2 weeks from applying. Your membership will be confirmed when the qualifications are verified.

7.5. In order to become a Fellow member of IAM RoadSmart you must be a current Full member and purchase and pass the Fellow entry test if you passed your advanced test more than 3 years ago. Those who passed their advanced test within the last 3 years can be automatically moved to Fellow membership tier. By becoming a Fellow member, you agree to take an advanced re-test every three years. Your annual membership fees will increase to include the cost of a retest (which means that you pay for your re-test in 3 advance instalments).If you fail a re-test, you will have the option of re-taking it until you pass, or reverting back to full membership.

7.6. If you decide to cancel your Fellow membership and do not take a test at the end of your 3-year period, we will not refund any money you’ve already paid for the re-test.

7.7. Each membership is valid for 12 months from the membership start date and is renewed for the next 12 months from the current membership expiry date upon the receipt of the annual membership fee payment.

7.8. Your membership agreement with IAM RoadSmart continues until: a) you notify us that you wish to cancel your membership, or b) your membership automatically lapses due to non-payment of the membership fee within 3 months of the membership expiry date. In this case your membership may be reinstated upon payment of the amount due at the discretion of the IAM RoadSmart Council.

7.9. If you wish to cancel your membership, you must notify us by emailing support@iam.org.uk or calling 0300 303 1134.

7.10. Membership fees are decided by members at the Annual General Meeting by a majority vote, therefore they can only change once a year or less often. We will inform all members of any changes to their membership fees via appropriate communication methods, for example email or post.

7.11. IAM RoadSmart membership fee does not include membership of a local IAM Group. If an IAM RoadSmart member wishes to be a group member, they need to pay the group membership fee(s) directly to the group(s) if applicable. Individuals are not allowed to be group members if they aren’t IAM members at the same time.

7.12. Each member will receive a renewal notice every year (at least 2 weeks before their membership expiry date) informing them of the fee they need to pay should they wish to renew their IAM RoadSmart membership for another year.

7.13. IAM RoadSmart accepts annual payments of membership fees via direct debit, bank transfer (including standing orders), credit or debit card (online or over the phone).

7.14. Members who pay by Direct Debit pay lower fees compared to members using other payment methods to reflect the lower processing costs of payments made via Direct Debit.

7.15. Direct Debits are called for on the first working day of the month your membership is due to expire. For example, if your membership is due to expire on the 31st of March, IAM RoadSmart will call for your Direct Debit on the 1st of March. All Direct Debits are protected by the Direct Debit guarantee.

8. Gift Aid

8.1. Gift Aid provides additional support for us by allowing IAM RoadSmart to add a tax refund to your membership subscription at no extra cost to you.

8.2. If you pay UK income tax at the basic rate (or higher) you can complete a Gift Aid declaration.

8.3. If you want to cancel your Gift Aid declaration, change your details such as name or home address or if you are no longer eligible for Gift Aid, you must notify us by one of the following methods:

a) Accessing your Member Dashboard and making the necessary changes.
b) Emailing us at support@iam.org.uk
c) Calling us on 0300 303 1134.

 

9. Code of conduct

9.1. Our members and customers must always:

a) respect IAM RoadSmart staff and volunteers,
b) refrain from engaging or participating in any form of inappropriate behaviour or act in any way that brings the organisation into disrepute, including but not limited to discrimination, physical, written, verbal abuse, bullying, filming or recording inside of the vehicle without prior consent, threatening behaviour, or harassment (this also applies to any interactions with the organisation, its staff and members via social media),
c) report to and discuss with IAM RoadSmart staff any problems or issues relating to the product/service they purchased and/or their membership in a reasonable and constructive manner,
d) not put the health, safety or wellbeing of themselves and others at risk during their courses or assessments.

9.2. Unacceptable behaviour will be reported to the senior leadership team of IAM RoadSmart and will be dealt with in accordance with the Articles of Association and the relevant IAM RoadSmart Group rules in force at the time of the incident. If the behaviour warrants, it will also be reported to the police.

10. Promotions and Promotional Codes

10.1. A full and correct promotional code must be quoted at the time of purchase in order to be redeemed. If the promotional code is not quoted at the time of purchase, IAM RoadSmart cannot refund the discount amount later.

10.2. Only one promotional code can be used per purchase.

10.3. We reserve the right to remove any promotional code from a product if it is deemed it is not applicable, e.g. a young person’s discount for 17–30-year-olds used by someone who is 55 years old.

10.4. We reserve the right to end a promotion at any time.

 

11. Confidentiality

11.1. IAM RoadSmart is committed to protecting the privacy and confidentiality of all participants.

11.2. Any personal information provided to us, including health-related information and emergency contact details, will be kept confidential and used solely for the purposes of course administration and emergency situations.

11.3. We will not share your personal information with third parties without your explicit consent, except as required by law.

2. Mental Health Considerations

12.1. IAM RoadSmart is committed to supporting the mental health and wellbeing of all participants. If you are experiencing mental health challenges that may affect your ability to attend or complete the course or assessment, please inform us as soon as possible. We will collaborate with you to make necessary adjustments, like rescheduling the course or providing extra support.

13. Changes to these Terms and Conditions

13.1. We review and may modify these Terms and Conditions from time to time.

13.2. Every time you purchase a product/service from us, the Terms and Conditions in effect at the time of your purchase will be the ones applicable to the fulfilment of your purchase.
